Who May need a Guardian?

If a health care professional has identified that their adult patient is compromised in his ability to make decisions, understand responsibilities of decisions or retain the information discussed with him then frequently a guardianship is recommended.

If a health care practitioner notes that their patient is chronically confused, forgetful, and non-compliant with medications or medical appointments and tests.

If a person is resistant to care being provided or is combative, assaultive, or threatening toward others without a rational reason.

If a person demonstrates unsafe behaviors which places his/her life at risk and is not able to understand his/her risks.

If a person is vulnerable to personal and financial exploitation.

Examples of medical conditions that frequently lead to the recommendation for guardianship.

  • Progressive dementia from a history of strokes, or neurological diseases, Alzheimer’s disease or other dementias.
  • Brain injury resulting in on-going difficulties in various functional or decisional areas.
  • Mental illness with an overlay of dementia.
